Donald Trump’s lawyers ask federal judge to dismiss election fraud case
“Everything that Smith did since Attorney General (Merrick) Garland’s appointment, as President Trump continued his leading campaign against President Biden and then Vice President Harris, was unlawful and unconstitutional,” the petition filed on Thursday alleges.
A Florida court has previously ruled that Smith was improperly appointed and rejected Trump’s lawsuit involving confidential information.
Earlier Thursday, Donald Trump said that he would use his presidential power to terminate special counsel Jack Smith’s investigations and remove him from office if elected. Smith has charged Trump with many crimes, and Trump has vowed to “fire him.”
Trump’s attorney claims in their filing to close the election fraud case that Garland was “following improper urging from President Biden to target President Trump, as reported at the time in 2022, and repeated recently by President Biden through his inappropriate instruction to ‘lock him up’ while Smith presses forward with the case unlawfully as the presidential election rapidly approaches.”
