Donald Trump may face legal problems if he loses the election

US ELECTION: According to a legal consultant who spoke to the media, former President Donald Trump would have significant legal issues if he loses the presidential race.

Greg Germain, a professor of law at Syracuse University in New York, told media report that Trump must defeat the federal accusations by winning the presidency. Trump is being charged with election fraud in Washington, D.C., federal courts.

Judge Aileen Cannon ruled that the top prosecutor, Jack Smith, was unlawful under the U.S. Constitution’s appointments clause, dismissing the charges against him for allegedly hoarding sensitive materials at his Florida home.

Smith is contesting Cannon’s ruling. The Justice Department may follow Cannon’s decision and choose an in-house prosecutor to handle the case if he loses.

“If Trump loses the election, he is in serious jeopardy in the federal criminal cases, especially the documents case, if Judge Cannon’s dismissal under the appointments clause is reversed or corrected by the Justice Department following the appeal,” Germain said.

Trump has many alternatives to end the federal prosecutions if elected, such as pardoning himself or selecting a supportive attorney general to dismiss the accusations.

After leaving the White House in January 2021, Trump was facing 40 federal charges in Cannon’s court for allegedly handling classified information taken from his Palm Beach Mar-a-Lago home. Additionally, he was charged with impeding federal agents’ attempts to recover them.

In his not guilty plea, the Republican presidential candidate claimed that the investigation was a political witch hunt.

In connection with an alleged pressure campaign on state officials to overturn the 2020 election results, Trump is charged in the Washington, D.C., case with conspiracy against rights, conspiracy to obstruct an official proceeding, conspiracy to defraud the United States, and obstruction and attempting to obstruct an official proceeding.

Trump has always claimed that he is the target of a political witch hunt and entered not guilty pleas to all of the allegations.

Additionally, Trump is involved in two state court proceedings.

He was found guilty in New York of fabricating documents to conceal payments of hush money to adult film actress Stormy Daniels. Daniels was paid off to keep her from disclosing an alleged relationship with Trump in a hotel room in Nevada, according to the trial testimony.

In Georgia, he is also accused of electoral fraud.

“The state non-criminal cases probably take the same course whether he is elected or not,” added Germain.

But according to a codified guideline from the Justice Department, presidents shouldn’t face charges while in office. Both state lawsuits would thus probably be delayed until after Trump’s departure.

On November 26, Trump is expected to be sentenced in the hush money case.

That punishment will probably be delayed until after Trump leaves the White House if he is elected on November 5.
